Heh, I don't have a problem with that per say, everyone tries to justify their existence. No, he declared a military action you fucking moron. The president can do that. There is a difference between a military action and war.

He cannot and did not declare war. The president does not possess the power to declare war.

The difference between the two is the funding behind it. A military action declared by the president is an action in which troops are deployed, but the military funding is not raised for the duration of the action. Thus leaving them with a limited allowance of funding to carry out the action they are deployed for. Extra funding must be approved by congress.

Actual declaration of war must also be approved by congress. Upon declaration of war by congress the military funding is increased for the duration of the war without individual increases to funding having to be approved by congress.

Technically speaking the Vietnam war for instance was not actually a war. It was a declared military action by the president, and never approved by congress to be a war.
